With the rising popularity of vaping, there are more and more rules regarding the use of vape pens and e-cigarettes than ever. However, the laws around this topic are still not very clear and may seem confusing to the large group of vapers, especially if they want to find out whether they may use their devices indoors or in public places. Let’s answer at least some of the most pressing questions, like is vaping indoors illegal, so you know what to do and what to avoid.

To vape or not to vape

It will be easier to start with places where vaping is legal. That includes various open areas that are accessible to anyone, such as public streets, pavements, urban spaces, and even parks and recreation grounds. Of course, you can also vape in your own house or apartment unless your landlord or tenancy agreement states otherwise.

Unfortunately, the matter gets a little more complicated from this point. So is vaping legal indoors? Well, it depends where you are! If we’re talking about the US, then we should mention that The United States Congress has not enacted any type of nationwide federal smoking or vaping ban in public places or workplaces. Even though there is no federal law, we need to look closer at each one of the states and see what rules they established regarding vaping indoors.

Is vaping indoors illegal in all states?

There are states which prohibit both indoor smoking and indoor e-cigarette use in such areas as private worksites, restaurants, and bars. Among them, we can find Oregon, California, Utah, Colorado, New Mexico, South Dakota, North Dakota, Minnesota, New York, New Jersey, Delaware, Connecticut, Massachusetts, Rhode Island, Vermont, and Washington D.C. In most of them, vaping is banned in all places where smoking is prohibited. As it happens, there are also a few states that do not regulate indoor vaping at all. You won’t find any local or state laws on this matter in Nebraska, Nevada, Rhode Island, and Tennessee.

What to do if you’re not sure about the rules?

Even if you happen to be in one of the states where vaping is not prohibited indoors, you should still be mindful of other people around you. Follow good manners and don’t vape in public places such as bars, cafes, restaurants, malls, workplaces, and various means of transport. If you’re at your friends’ or family’s house, ask them if you can use your device inside.

Vaping indoors abroad

How do things stand outside the US? Is vaping indoors abroad possible? Well, this obviously depends on the country you happen to be in. For example, in France or Croatia, vaping is treated the same as smoking and is banned in all public buildings. If someone catches you, you will be fined. On the other hand, some countries prohibit vaping only in chosen spaces such as hospitals and public transport – such laws have been established in Poland. The differences may be pretty significant, so you should always check the regulations if you travel abroad and want to vape in another country.
